Rules

1. The Granite Transformations 10 Years/10 Days in Italy Contest (the “Contest”) begins on February 22, 2011 at 12:00:01 am ET and ends on September 16, 2011 at 11:59:59 pm ET (the “Entry Period”). The Sponsor of this Contest is Granite Transformations (“Sponsor”).
2. HOW TO ENTER: Either create a video or write an essay (a “Submission”) showcasing why you love your Granite Transformations kitchen or bathroom renovation. Submit your video or essay by navigating the Internet to www.granitetransformations.com and following the instructions to enter and upload your Submission. Your entry must be submitted online by September 16, 2011 at 11:59:59 pm ET, when the Contest ends. Proof of uploading is not proof of the Sponsor’s receipt and the Sponsor’s designated computer is the only valid official time-keeping device for this Contest. Entries will be disqualified if they contain any inappropriate material or language, including profanity. Limit one entry per household
   Submission Requirements:
   • All video submissions must be no more than 5 minutes in length
   • The maximum file size for any video submission is 20 MB
   • Video submissions must be in one of the following file formats: .WMV, .AVI, .MOV, or .MPG
   • All essay submissions must be 500 words or fewer
   • All Submissions must be in English
   • Submissions must be your original work, may not have been published previously, must not infringe third-party rights, including trademark, copyright and right to privacy and publicity, and must be suitable for publication, as determined solely by Sponsor.
   Entries without all of the required information will be disqualified. All Submissions become property of Sponsor and none will be acknowledged or returned. Sponsor will be collecting personal data about participants when they register and enter the Contest. Please review the privacy policy of the Sponsor at www.granitetransformations.com. By participating in the Contest, you agree to all of the terms and conditions of the privacy policies and website terms and conditions of the Sponsor. For Canada residents: The personal information you are providing to enter this promotion will be used only to administer the promotion.
3. ELIGIBILITY: The Contest is open to legal residents of the 50 United States excluding MD and VT, the District of Columbia, and Canada, excluding Quebec, ages 18 or older, which have had a kitchen or bathroom renovation project done by Granite Transformations. Employees, officers and directors of Granite Transformations, Rocksolid Granite (USA), Inc., The Concept Studio LLC, and their respective parent companies, subsidiaries and affiliates and their advertising, promotion, and fulfillment agencies are not eligible to enter or win. Immediate family members and household members of such individuals are also not eligible to enter or win. “Immediate family members” shall mean parents, step-parents, legal guardians, children, step-children, siblings, step-siblings, or spouses. “Household members” shall mean those people who share the same residence at least three months a year. Subject to all applicable laws. Void in MD, VT, Quebec and where prohibited.
4. JUDGING/WINNER SELECTION: All Submissions will be judged by a panel of judges who will select one (1) Grand Prize Winner on or about September 26, 2011 based on the following criteria: creativity and originality of Submission (34%), structure of Submission (34%), and relevance of Submission to Contest theme (32%). In the event of a tie, the Grand Prize Winner will be determined by the judging organization based on the highest score for creativity, structure and originality.
5. VALIDATION: Potential Grand Prize Winner will be notified by overnight mail, telephone or email on or about September 30, 2011. Winner may be required to sign and return, when requested, an affidavit of eligibility, prize/publicity release and an assignment of rights to his/her Submission within seven (7) days of receipt of attempted notification. Winner’s travel companion must also sign a liability/travel release. If any winner is a minor in his/her state of residence, documents must be signed by his or her parent or legal guardian. Contest materials, entries and Submissions are subject to validation by the judges. By taking part in this Contest, you agree to be bound by these rules and all decisions of the judges and Sponsor which are final and binding on all aspects of the Contest.ONE (1) GRAND PRIZE: For U.S. residents: A trip for two (2) to Venice, Italy. Prize consists of: Round-trip coach air transportation for winner and a guest (who, if minor, must be accompanied by parent or legal guardian) between Venice, Italy and a major city in U.S. nearest winner’s home; ten days/nine nights hotel accommodations for two (one room/double occupancy); use of a rental car during the trip; and a tour of the Orsoni Factory where the art of glass mosaic is taught. (Approximate retail value: $7,500, depending on departure city and timing.) All travel dates and arrangements are subject to availability. Blackout dates may apply. Winner and guest must travel on the same itinerary. All costs and expenses not specifically listed herein, including but not limited to gratuities, meals, all federal, state and local taxes, expenses, including expenses to operate the vehicle, travel insurance, rental car insurance, optional extra activities, and any other incidentals not mentioned herein are the sole responsibility of the winner. A major credit card will be required at hotel check-in to cover any miscellaneous expenses. Winner and guest must have a valid U.S. passport and have obtained all necessary documentation, etc., to travel abroad. Winner must have a valid U.S. driver’s license to obtain rental car. Sponsor and its agents do not make, nor in any manner are responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the rental car, including but not limited to its quality, fitness for purpose or mechanical condition. Selection of size/type of rental car is solely at Sponsor’s discretion, and upgrades are responsibility of winner. Winner must travel on or before September 30, 2012. For Canada residents: Grand Prize consists of: home renovation materials and related services from Granite Transformations up to a value of $7,500. Winner is responsible for all taxes and other expenses not listed herein. No substitutions or transfers of prize, except at Sponsor’s discretion. Allow 6-8 weeks after validation for arrangement of receipt of prize.
6. GENERAL CONDITIONS/INDEMNIFICATION: By participating in this Contest and/or by accepting any prize that you may be awarded, you agree that Sponsor, The Concept Studio, LLC, their respective parents, subsidiaries and affiliated companies, units and divisions; and their advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives and employees; and each of these company’s and individual’s respective successors, representatives and assigns (collectively, the "Indemnified Parties") shall not be liable for any and all actions, claims, including any third party claims, injury, loss or damage, including death, arising in any manner, directly or indirectly, from or relating to this Contest, including your entry, Submission, and participation in this Contest, or the acceptance, possession, use or misuse of any prize. By participating in the Contest and/or accepting any prize that you may be awarded, you agree to fully indemnify each Indemnified Party from any and all such claims by third parties without limitation. The Indemnified Parties shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete, unreadable, inaccurate, garbled or unintelligible entries, communications or submissions, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by your participation in this Contest or resulting from acceptance, possession or use of a prize; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Contest. The Indemnified Parties disclaim any liability for damage to any phone, computer or other electronic device resulting from participating in, or accessing or downloading information in connection with this Contest, and Sponsor reserves the right, at its sole discretion, to cancel, modify or suspend the Contest should a virus, bug, computer or phone problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Contest. Sponsor may prohibit you from participating in the Contest or winning a prize if, at its sole discretion, it determines you are attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other participants or Sponsor representatives. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE CONTEST’S WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHALL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.By entering, you authorize Sponsor, its affiliates and designees, and their respective agents and agencies to use your name, voice, likeness, statements, photograph, biographical data, city and state of residence for advertising and publicity purposes, worldwide in perpetuity, or on a winner's list, if applicable, without further compensation unless prohibited by law. By entering, you grant an unrestricted, irrevocable, exclusive license to Sponsor, its affiliates and designees, and their respective agents and agencies, to publish, use, adapt, edit and/or modify your entry Submission in any way, in any and all media worldwide, without limitation and without further compensation. Sponsor is not obligated to use any of the above mentioned information or materials. By entering, you also agree that your name, address (city/state) and Submission may be posted on the Contest website. You also agree that you will not use entry Submission for any purposes other than in connection with this Contest or for personal use. By entering, you warrant and represent that you are the writer of the submitted essay or videographer of the submitted video and that you have obtained all permission necessary for Sponsor to publish or use your Submission in any media worldwide, including, but not limited to, permission from all persons depicted in your Submission and from any holder of copyrights, trademarks or other rights in materials or other items depicted in your Submission. By entering, you also agree to confirm to Sponsor any of the above in writing.
